SUMMARY:

Most of the topics of discussion throughout the day concerned the language of the four TA's which were agreed upon.

The Union presented the Company with a copy of an email addressed to the Dealers which concerned the payment of tokes to Dealers. The email had no date on it and the Union was told that it was sent several years ago as evidenced by the phrase "vacation tokes". The Company explained that the intent of the letter has been improperly interpreted by the Dealers. The Company stated that the Dealers MAY pay out PTO tokes for any reason they wish at any time they wish and acknowledged that the Dealers do have Toke By-Laws and that the Company would NOT interfere with the Dealers Toke By-Laws. When asked specifically about Dealers who have taken an FMLA and requested "Hospital Tokes", the Company responded by saying the Dealers can distribute their tokes however they see fit.

The Company agreed to discuss any "Discipline" with the Union on a per case basis outside of negotiations.

The Company provided the Union with a list of those who have received "discipline" and "commendations" since the April of 2007. This list was the same as the list previously provided by the Company, however now the "log" had been color-coded to more easily separate the different circumstances.

Several more "tentative" dates for negotiations were set and will be confirmed at our next session.

The Company presented FIVE proposals to the Union for their review:

  1. Jobs, Job Posting and Transfers

  2. Union Security

  3. Seniority, Layoff and Recall

  4. Controlling Law

  5. Miscellaneous

The Union and Company came to agreement on FOUR more "Tentative Agreements" ("Tentative Agreements" are agreements which both sides have come to on particular "proposals". "Tentative Agreements" are referred to as "TA's". Keep in mind that these are subject to change throughout the course of negotiations and nothing is "final" until everything is "final" and then presented to the Bargaining Unit [eligible Dealers] for "Ratification")

  2. "Legality" (TA on 5-29-08)

  3. "Funeral Leave" (TA on 5-29-08)

  4. "Employment" (TA on 5-29-08)

 

The Negotiations adjourned at 4:30pm.
