COMPANY PROPOSAL:

ARTICLE 1

RECOGNITION

1. The Employer recognizes the Union as the sole and exclusive collective bargaining representative for all full time and regular part time table games dealers employed by the Employer at its facility located at 3570 Las Vegas Boulevard South, Las Vegas, Nevada, excluding temporary employees, slot technicians, all other slot machine related employees, dual rate employees, all cashiers, pit clerks, clerical employees, poker room dealers, engineers, floor supervisors, pit managers, all supervisors as defined in the National Labor Relations Act, as amended, and any other classification of employees not expressly listed herein and as certified by the National Labor Relations Board in Case Number 28-RC-6573. This Agreement does not apply to or cover any other Employer, including the Employer’s parent Company or its subsidiaries, nor any other classifications employed by the Employer. [Open]

2. This recognition clause shall be construed to apply to employees only and not to work. It shall not be construed as a guarantee, implicit or implied, that any work currently or subsequently performed at the Employer shall continue to be performed at the Employer or as a guarantee of employment of any employee, nor shall it limit the Employer’s right to contract out work, to relocate work, to transfer work to other employees, nor construed to mean that any employee or classification of employees has an exclusive right to any work. The specific terms of this Agreement shall be the sole source of any rights that may be asserted by the Union against the Employer. [Open]

3. The Union recognizes the fact that there are employees not covered by this Agreement, and as to such employees, it is agreed that neither the employment of them nor any action taken by them, including, but not limited to organizational activities engaged in by any other labor unions, shall not constitute a grievance or be grounds for strikes, lockouts, boycotts, handbilling, slowdowns, disruptive organizing activities or other economic interference with the continuous smooth operation of the Employer’s business. UNION COMMENTS/OPINION: The company is trying to tie what has already been recognized by the National Labor Relations Board, Recognition, in with other proposals covered elsewhere.
