COMPANY PROPOSAL:

ARTICLE 16

JOBS, JOB POSTING AND TRANSFERS

1. When a bid for shifts, days off, or job openings occur (including New Games within the Bargaining Unit, as defined in Article ___), a bid, if utilized, will be posted for five (5) calendar days. Employees wishing to bid must complete a bid form. The bid may be awarded to the employee who has the skill and qualifications to efficiently perform the work. The Employer may fill the vacancy during the posting period. [Open]

2. The Employer shall have no obligation to transfer employees or post bids for any job openings and may fill such positions, whether or not bid, with external hires or non-Bargaining Unit transfers, at its discretion. [Open]

3. The determination as to whether the employee(s) possess the skill and qualifications referred to in this section shall be at the sole discretion of the Employer, provided that such determinations are not arbitrary and capricious. [Open]

UNION COMMENTS/OPINION: This company proposal says we can bid for shifts, days off or job openings, but the company may refuse the bids at their discretion and fill the positions with whoever they want.
