may be longer between rest breaks. Employees
may take their breaks outside, in the lounge, the cafeteria and/or the outdoor
smoking area. [Open]
3.
All hours of work in excess of forty (40) hours in any one (1) week shall
be paid for at the rate of one and one half (1½) times the employee’s regular
straight-time hourly rate of pay. There
will be no pyramiding of overtime pay, or premium pay under any of the terms of
this Agreement; that is, no type of premium or overtime pay shall be combined
with or paid concurrently with any other type.
Where more than one (1) premium or overtime rate applies to the same
hours of work, the higher rate only shall be paid.
[Open]
4.
When a need for emergency overtime occurs, it will be first offered on
the shift of scheduled Full Time Regular employees who are qualified to work the
classification in which the overtime occurs.
If no employee accepts the overtime, the overtime may then be forced in
reverse rotation order. Overtime
shall be an essential function of the job, and the Employer shall have the right
to require employees to work overtime. [Open]
5.
Employees may sign in advance for scheduled, non emergency overtime
opportunities, on their shift, which may occur on their days off.
Such overtime will be rotated on a dealer game assignment and pit
seniority basis among the employees who have signed the list.
[Open]
6.
If the Employer cannot cover the overtime as outlined in Sections 4 and 5
above, the Employer may assign non-Bargaining Unit employees to perform the
work. [Open]
7.
Generally, graveyard shift will commence between 4 am and 12 noon.
Generally, day shift will commence between 12 noon and 8 pm.
Generally, swing shift will commence between 8 pm and 4 am.
The Employer retains the right to change the time periods within which
shifts will commence and end.
[Open]
8.
The work schedule shift(s) will contain permanent days, which shifts
shall be selected by Classification Seniority.
[Open]
9.
Voluntary Early Out requests will be recorded on a Voluntary Early Out
list which will be recorded and accepted prior to the start of the employees’
scheduled shift. Recorded requests will be honored on a first come basis.
In the event it becomes necessary to send more employees home than those
recorded on the Voluntary Early Out list, the forced early-out will be first
offered by “dead game” or similar game type.
If no employee accepts, it will be mandated.
UNION COMMENTS/OPINION: This company proposal will make it where dealers work hour-twenties+ and 20 minutes off. Then, amongst other things (forced OT and the use of non-union employees to fill the spots), this company proposal states that they can force out anyone they want, no matter if the employee was forced out the day before and no other employee has been forced out prior to them being last forced out.
