
COMPANY PROPOSAL:
ARTICLE 3
UNION SECURITY
1.
Neither the Employer nor the Union will restrain, coerce, threaten or
intimidate employees in their choice whether to join or not join the Union.
Both parties recognize that this choice is solely that of the employee. [Open]

Nevada is what is commonly referred to as a “Right To Work
State.” Under the law, an employee may join the Union or refrain from
joining the Union. In other words,
membership in the Union is not a condition of employment.
The Union recognizes and agrees that it has a duty to represent all unit
employees without regard to whether they choose to join the Union or refrain
from doing so. [Open]
3.
Employees may become a full fledged member and thereby, obligate
themselves to tender periodic dues and initiation fees uniformly required as a
condition of acquiring or retaining membership in the Union. [Open]
4.
The Employer will not be required to terminate the employment of any
employee who has voluntarily chosen to become a member and thus, is required to
pay membership dues, until the expiration of thirty (30) days after receipt of
notice in writing by the Union to the Employer that such employee has failed to
remit the membership dues fee, which the employee obligated himself to pay be
becoming a member. The Union must
also provide the employee with written notice that they face loss of employment
because of their failure to pay the dues that they agreed to pay as a member at
the same time the Union notifies the Employer of the same, and must comply with
all applicable legal standards with respect to providing notice to the employee.
An employee who has failed to remit the membership dues required as a
member shall have the right to pay such dues within said thirty (30) day period
without affecting such employee’s continued employment status.
It is understood and agreed that loss of good standing in the Union for
those employees who opt to join the Union shall not affect continued employment
unless such loss is for reason of failure to render regular monthly membership
dues, initiation fees or assessments uniformly required by the Union of all
employees who opt to become members. [Open]
The Union will defend, indemnify and save
harmless the Employer against and from any and all claims, demands, liabilities,
and disputes, including reasonable attorney fees, arising out of, or by reason
of, action taken or not taken by the Employer for the purpose of complying with
this Article. [Open]
