UNION PROPOSAL:

ARTICLE 17: Working Conditions

Section 1.0     Work Rules, Policies and Procedures

No changes to existing work rules, policies and procedures shall be made unless upon notice to the Union and mutual agreement thereon.  The work rules policies and procedures shall not conflict with this agreement and where any conflict exists, the terms, conditions and prevailing rights shall prevail.  Any proposed changes shall be provided be provided to the union for review and approval and if agreement is reached, may be applied no earlier than 72 hours from agreement thereon unless otherwise mutually agreed.  Any agreed changes shall be provided to employees 72 hours before effective.

It is incumbent upon the Employer to remove any Employee, upon said Employees request, from any work situation where the Employee is being verbally, physically or emotionally abused or threatened.  The Employer will assure enforcement of Nevada Statutes  203.010 (Breach of Peace) and 200.571 (Anti-Harassment) and 193.1675 (Anti-Hate Crime) as well as such other statutes needed to insure employee safety. Employees retain the right to contact Employer security or law enforcement when the employee deems it appropriate

Findings of any Shoppers Program shall be used for purposes of training /retraining and not for disciplinary purposes. 

Section 1.1 Smoking Area

         The Employer agrees to continue to provide a designated smoking area.

Section 1.2     Dealer’s Lounge

The Employer shall provide a dealers lounge solely for the use by dealers, security and slot department employees, which shall provide the following items, including but not limited to:  Individual lockers for every employee, refrigerator, microwave oven, fountain drink dispenser, coffee maker with cream dispenser, sink with hot and cold running water, house phone, televisions, tables and chairs, coat closet with storage cubicles, quiet room, yogurt and fresh fruit.  In addition, a porter shall be assigned to the lounge to provide, among other things, security.

Section 1.3      Working Hours and Schedules

a.       The employer shall maintain the following shifts:

1)     Graveyard shift which shall begin between the hours of 2 a.m. and  4:00 a.m.

2)     Day shift, which shall begin between the hours of 10 a.m. and 2 pm.

3)     Swing shift which shall begin between the hours of 6:00 p.m. and 10:00  p.m.

b.      A regular work week will begin with the first Graveyard Shift on  Friday morning, and finish at the end of the latest starting shift for Swing Shift on the following Thursday.

c.       The work week for full time employees  will consist of 5 consecutive days of eight (8) hour shifts,  or 4 consecutive days of 10 hours, all of which on the same shift, and 2 (3 for 10 hour shifts) consecutive days off.   All current assigned shifts, starting hours, days off, and schedule, as of date of certification, shall continue.  Vacancies in shifts, starting hours, schedule or days off shall be based on bid by property classification seniority.

d.      The Employer agrees to establish and maintain a voluntary rotating list for each shift for the following:

        1)     Extra days off.

        2)     Extra days working.

These lists shall be based on Property Classification Seniority. The Employer further agrees to make any and all lists available for Employees viewing upon request.

e.       The Employer agrees to allow Employee’s to swap days off with one another utilizing a shift pick-up sign-up sheet.

f.        The Employer agrees not to force any Bargaining Unit Employee to work overtime.

Section 1.4      Early- Out  and Extra- Hour Lists

a.       The Early-Out Lists is established for the purpose of reducing staffing when business needs require.  Employees voluntarily agreeing to early out shall not be penalized with loss of benefits, full time status, seniority, or change of schedule, or shift, nor shall such time be charged to vacation/PTO leave bank. Attendance points shall not be charged for such time.

b.      An extra hour list shall be established for employees willing to work additional hours after their shift.

Section 1.5      Full Time Employment

a.       It is the intention of the parties to provide full employment for bargaining unit employees.  To that end, it is agreed that at no time shall the number of part time employees/positions exceed 25% of the work force.  

b.      Where vacancies exist in full time positions, which are not bid on by senior fulltime employees, such vacancies shall first be filled by senior part time employees.

Section 1.6   Posting of Work Schedules

All work schedules shall be posted no later than the Tuesday one week prior to the beginning of the new schedule at the current location.
