UNION PROPOSAL: Article
22: Progressive Discipline
Section
1.0
The Employer has the right to impose disciplinary with just cause.
Discipline shall be imposed in a progressive manner.
Progressive discipline includes oral warning with or without notes to
file, written warning, written reprimand, suspension, last chance agreement, and
termination. Section
1.1
In the event that an Employee is requested to participate in an
investigatory interview that could result in that Employee being disciplined,
the Employer will inform said employee of his or her rights to have a Union
representative present for said meeting. On each contract anniversary year, the
Union will provide the Employer with a list of names of three (3) bargaining
unit members per shift that will serve as Employee representatives for
investigatory interviews. In the event none of the designated representatives
are immediately available, the Employee may select another representative who
must be available within sixty (60) minutes. The Employee representative shall
be paid for his or her time as if he or she were in work status. Section
1.2
The employee shall have the right to submit a written rebuttal to any
discipline documented in his or her file which shall be included in the
Employee’s file. Section
1.3
If, after six (6) months from the date of
the conduct giving rise to the discipline,
the Employee has not been disciplined,
all documents referring to this incident shall be removed from the
employee’s file. Section
1.4
Any and all entries placed in an Employees file(s) shall be made
available to the Employee, upon written request through Human Resources within
seventy-two (72) hours from the date of request.
